DV Lottery 2027 Kenya: Court Rulings & What Happens Next
By Luvisia Digital Limited · Reviewed 7 November 2026

DV lottery 2027 registration was still unavailable on the official U.S. entry website when we checked on 7 November 2026. For Kenyans and other African applicants asking what happens next, the immediate step is to prepare carefully and wait for a verified registration announcement.
The Democrats’ election victory has raised fresh hopes, but it does not itself open the application system. Understanding the situation means separating three issues: the new entry rules, court cases affecting different programme years, and the powers of the incoming Congress.
Status checked: 7 November 2026. New DV-2027 entries: unavailable. Confirmed opening date: none found in the official sources checked. This article is an explanation of the current position; it is not an announcement that applications have opened.

DV lottery 2027: the current position
The official Electronic Diversity Visa portal says entries are not being accepted. It still displays the old DV-2026 registration dates of 2 October–7 November 2024. Those dates do not announce a new window in November 2026.
The State Department’s DV-2027 entry-period notice says it will announce the registration start and results dates. It identifies 1 October 2026–30 September 2027 as the visa application period for people selected for that programme. That fiscal-year period is different from the lottery entry window.
A person waiting to enter the draw and someone already selected in an earlier draw are therefore in different positions. Before acting on a headline, check which programme year it concerns and whether it deals with registration, selection or visa processing.
How the DV process normally works
The Diversity Immigrant Visa programme provides an immigration route for people from countries with historically low immigration to the United States. An entry in the draw is the first stage; selection gives someone an opportunity to pursue a visa, subject to eligibility, processing and visa availability.
The usual sequence is: an official entry period, random selection, a results check, then further forms, documents and an interview for eligible selectees. Selection alone does not mean a visa has been approved. The State Department’s programme instructions explain the stages. Always use the instructions for the relevant year.
What changed: a timeline
| Date | Development |
|---|---|
| 16 September 2025 | A final rule introduced a US$1 government lottery registration fee. |
| 5 November 2025 | The State Department said DV-2027 entry dates would be announced later while it changed the entry process. |
| December 2025 | The government paused diversity visa issuance, citing a review of screening and security procedures. |
| 10 April 2026 | The new passport-information and passport-scan rule took effect, with limited exemptions. |
| 28 August 2026 | The Medani litigation produced an order affecting processing holds for DV-2026 applicants. |
| 14 and 29 October 2026 | A district court ordered DV-2027 registration to open; the appeals court then paused that injunction. |
| 3–4 November 2026 | AP called Democratic control of both congressional chambers. The new terms begin in January 2027. |
The dated fee rule, passport rule and sources below explain these developments. A change to entry requirements and an announcement opening registration are separate events.
What did the courts actually decide?
Medani: processing for existing DV-2026 applicants
In Medani et al. v. Trump et al., the court’s 28 August 2026 order addressed policies holding up existing DV-2026 applications. The State Department’s 31 August update states that the December 2025 diversity visa issuance pause was no longer in effect under that order.
A 30 September supplemental order also granted limited additional processing relief for affected FY-2026 consular cases. It did not open a fresh DV-2027 lottery. Earlier selectees should obtain advice on the latest orders and their own case rather than assume every expired case has automatically reopened.
Red Eagle: the DV-2027 opening order was stayed
On 14 October 2026, the district court in Red Eagle Law, L.C. v. Rubio ordered the State Department to announce registration by 29 October, open it by 1 November and notify selectees by 3 December.
On 29 October, the Ninth Circuit stayed that injunction pending appeal. A stay pauses the order’s operation: those dates are therefore not a currently enforceable registration timetable.
The panel focused on the plaintiff law firm’s right to sue. It found the firm’s business interest outside the statutory zone of interests—the interests the DV law protects. A separate concurrence also questioned constitutional standing. The panel expressly declined to endorse the Department’s failure to open registration. This was not a ruling that Congress had abolished the lottery.
Will the Democrats' win reopen the lottery?
The Associated Press called Democratic control of the Senate on 3 November and the House early on 4 November 2026. However, the incoming members’ terms begin at noon on 3 January 2027 under the Twentieth Amendment. The election result has not already replaced the sitting Congress.
Our assessment is that the result creates opportunities for greater scrutiny of the administration, but it does not guarantee a particular DV outcome. Congressional committees can question officials and examine implementation; lawmakers can also pursue legislation and use the funding process. Whether they prioritise DV reform, and whether a proposal succeeds, remains uncertain.
Congressional majorities also do not automatically become law. Under the Constitution’s Article I, section 7, legislation normally needs both chambers and presidential approval; overriding a veto requires two-thirds support in each chamber. Winning a majority is therefore different from having the votes to overcome a presidential veto.
For applicants, a political statement is a signal to watch. An official entry notice, an operative court order or an enacted law provides a firmer basis for action.
Must the Trump administration follow the courts?
The relevant question is which order is legally in force, what it requires and whom it covers. An administration can appeal an adverse ruling and ask a court to suspend it. An appeal alone and a court-granted stay are different things.
Here, the registration injunction remains stayed. November’s election does not change its legal status.
The Medani supplemental ruling illustrates a separate issue: courts can be asked to enforce their orders where compliance is disputed. Applicants should distinguish an allegation of noncompliance, a request for relief and relief a court has actually granted.
Passport and fee changes to prepare for
A valid passport and a passport scan
The final passport rule, published on 11 March 2026 and effective from 10 April, requires the entrant’s valid, unexpired passport information and a scan of the biographic and signature page, subject to limited exemptions. The Department states that it is implementing the rule with DV-2027.
For a Kenyan planning to enter, checking passport validity and organising a clear scan are useful preparation. Do not assume a national ID replaces the passport requirement. Our Kenyan passport application support page explains the administrative assistance available. The existence of this rule does not mean the entry portal is open.
The US$1 government registration fee
The September 2025 final fee rule introduced a US$1 registration charge. The current government fee schedule lists US$1 payable at registration by the principal applicant and a separate US$330 visa application fee per person applying as a selectee.
Some older guidance still describes lottery registration as free. Use the newer fee rule and the instructions issued for the actual opening. A private assistance charge is separate from either government fee. Follow the official payment instructions when registration opens; a payment to an agent cannot reserve a place in a closed draw.
What could happen next?
These are possible developments, not announced outcomes:
- An administrative announcement: the State Department could publish entry dates and the operational instructions applicants need to follow.
- Further litigation: another court decision could change the legal position. Its scope and any stay would need checking before treating it as permission to apply.
- Congressional action: the incoming Congress could pursue oversight or legislation. There is no guaranteed timetable or assured result.
We cannot responsibly predict an opening date. Nor should applicants assume delays will automatically extend the programme’s stated visa period beyond 30 September 2027. Any extension or other remedy would need a clear legal basis and a verified announcement.
What Kenyan applicants should do now
- Prepare consistent personal details. Check names, dates and places of birth against your documents. Organise accurate marital and family information; follow the coming year’s instructions on whom to include.
- Review the qualifying requirements. The principal applicant must meet the programme’s education or qualifying work-experience standard. The official qualifications guidance explains that not every occupation qualifies. A Kenyan applicant’s education needs to satisfy the relevant U.S. standard; a private service provider cannot waive it.
- Check the relevant country list. Follow the new annual instructions on country of eligibility, usually based on country of birth, including any permitted exceptions. Residence in Kenya or another African country does not by itself establish eligibility.
- Organise your passport and a suitable photograph. Follow the official entry instructions and photo requirements. Avoid altered identity photos and old files that no longer meet the requirements.
- Plan for a single, accurate entry. When the window opens, coordinate any assistance so nobody submits a duplicate for you. Review your information and retain your own confirmation number. The official submission guidance explains the duplicate-entry rule and confirmation process.
Continue your work, studies and other lawful plans while waiting. Preparation can reduce last-minute mistakes, but spending money now does not improve the random selection outcome or guarantee that registration will open.
Common questions from applicants
Can I enter now through Luvisia Digital?
We can discuss preparation, but we cannot submit an entry while the official system is closed. Any service agreement should identify whether it covers preparation now or submission assistance after an announced opening.
Can someone guarantee selection or a green card?
No private provider can guarantee selection or visa approval. Be cautious about supposed priority slots, guaranteed winners or payments to unlock selection. Read the State Department’s fraud warning and verify the official web address yourself.
What if I was already selected for DV-2026?
That is an existing-case question rather than a new-entry question. Keep your records and official correspondence, and obtain case-specific advice from an appropriately authorised U.S. immigration professional. This guide does not determine whether a particular court remedy applies to you.
